Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mindspan platform at app.mindspan.com.au and any associated services operated by Mindspan Pty Ltd ("Mindspan", "we", "us"). By creating an account or purchasing a program, you agree to these Terms.

If you do not agree, do not use the platform.

1. Platform description

Mindspan provides psychoeducational resources and exam preparation programs for psychology students and registered psychologists. The platform includes free Hub resources and articles, and one-off study programs available for individual purchase (together, the "Services").

The platform is not a clinical service. Nothing on app.mindspan.com.au constitutes psychological treatment, clinical advice, supervision, or a therapeutic relationship. All content is for educational purposes only. For clinical support, consult a registered psychologist or mental health professional.

2. Account registration

You must be 18 years or older to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@mindspan.com.au if you suspect unauthorised access.

Accounts are personal and non-transferable. Sharing login credentials with others is prohibited.

3. Purchases and payment

Study programs (e.g., OSCE Psychology Exam program): Payment is a single, one-off charge in Australian Dollars including GST. Access is granted for 12 months from the date of purchase. There is no recurring charge and no automatic renewal. A tax invoice is issued automatically to the email provided at checkout.

Hub resources and articles: The Hub resources and articles are free to access. There are no Hub subscriptions and no recurring fees.

All payments are processed by Stripe. By purchasing, you agree to Stripe's terms of service. We do not store your payment card details.

4. Refund policy

Study programs: 14-day no-questions refund from the date of purchase. Email info@mindspan.com.au within 14 days. Access is revoked on refund. This policy operates in addition to, and does not limit, any rights you have under the Australian Consumer Law.

Your rights under the Australian Consumer Law (including consumer guarantees) are not excluded by these Terms.

5. Intellectual property

All content on the platform — including text, HTML files, PDFs, audio, video, quiz questions, clinical frameworks, and graphic elements — is the intellectual property of Mindspan Pty Ltd or its licensors and is protected by Australian copyright law.

Your purchase grants you a personal, non-exclusive, non-transferable licence to access and use the materials for your individual study. You may download PDFs for personal offline use. You may not:

To the extent permitted by law, the platform and all content are provided "as is" without warranty of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that any content is complete, accurate, or current.

Study materials are educational resources created in good faith by a registered psychologist. They are not a guarantee of exam success. The Psychology Board of Australia's official materials remain the authoritative source for OSCE requirements.

8. Limitation of liability

To the maximum extent permitted by the Australian Consumer Law, Mindspan's total liability to you for any claim arising out of or in connection with the platform is limited to the amount you paid for the relevant Service in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or special damages, including loss of profit, loss of data, or exam outcomes.

Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under the Australian Consumer Law.

9. Termination

We may suspend or terminate your account if you breach these Terms. If we terminate your account without cause, we will refund any unused portion of a prepaid program on a pro-rata basis. You may delete your account at any time from your account settings.

10. Governing law

These Terms are governed by the laws of Victoria, Australia. Any dispute that cannot be resolved by agreement will be subject to the exclusive jurisdiction of the courts of Victoria.

11. Changes to these Terms

We may update these Terms at any time. Material changes will be notified by email or platform notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
